Chandler City Ordinance 11-6

It shall be unlawful within the city limits for any person to have in his possession, carry or use, except within the confines of his domicile and premises, or encased, unloaded or in an otherwise inoperable condition, any air gun, B.B. gun, gas-operated gun, or spring gun or any instrument, toy or weapons commonly known as a "peashooter", "slingshot" or "beany" or any other instrument, including but not limited to bows and arrows, made for the purpose of throwing or projecting missiles of any kind by any means whatsoever, whether such instrument is called by any name set forth above or by any other name. Parents of children who have been found to be in violation of this section shall be responsible for any damage or injury done by such children to the person or property of others in accordance with the provisions of sections 12-661 and 15-446 of the Arizona Revised Statues, 1956.

It is very unlikely to break window glass or scratch car paint. Are these guns too much for use in a public park around smaller children? Perhaps. A criminal act? No.

Yet Chandler feels it necessary to have on its books the recently publicized ordinance 11-6, a law that makes it a crime merely to possess such an instrument. I say instrument because the law states that the possession of any instrument capable of firing a projectile qualifies. You do not actually have to fire it, harm anyone, harass anyone or damage anything. If your 7-year-old goes into a store and buys a Nerf gun, unwraps it, and emerges into a public place, then 11-6 has been violated.

If this isn't enough, Chandler makes this a Class 1 Misdemeanor, a criminal offense. It is punishable up to six months in jail and/or a $2,500 fine. According to the federal courts, and the state, a misdemeanor does not entitle you to a trial by jury. You will be tried by a judge who is paid by Chandler.

Chandler police showed up on my door because a friend of my son was shooting a soft-air gun from my son's car. Nobody was hurt, nobody was threatened. The witnesses to this crime were concerned there might be property damage, but there is none. Now both my son and his friend are being prosecuted for a crime, and in practice, a cranky judge could require that both of them spend time in jail.

Rest assured, I am not happy with my son's actions, and he got in trouble for it, and the gun (read that toy) was taken. But the actions of the police and our government are way out of line considering the offense.

My elected officials tell me that no police officer would ever cite someone violating this law unless some harm was done. They tell me that he might have been shot. Yes, that is indeed a real risk, and if I throw a banana peel out on the sidewalk, someone may slip and they may break their neck, but that doesn't make it a criminal act. We cannot punish based on the extreme bad luck scenario. A crime is all about intent.

I recommend several remedies, all of them needed, since our government has apparently lost its good sense and perspective. I call upon the Chandler City Council to repeal this ordinance immediately. If another is needed in its place, then I recommend civil fines only, and that it require that someone actually does harm in some way, not merely possess a projectile-shooting toy. Prohibition from places of common public enjoyment, such as a park, makes sense, provided it is in plain view (not in a vehicle).

I call upon the Arizona Legislature to remove from cities the right to pass local criminal statutes, and limit severely the amount of a civil fine, say not to exceed $2,500.

A crime should be known intuitively. It should involve intent to harm or profit at the unwilling expense of another. Not the mere possession of something like a toy. If it's serious enough to be jailed for, it's serious enough for one standard statewide.

Lastly, I call upon the federal government and the state Legislature to restore our constitutional right to jury trial by peers. The incarceration of someone even for one day is too harsh a punishment to not have a right to a jury, and there are no limits on how high a fine can be. The state can take your life assets away from you without so much as a nod by your peers. Folks, do you have any idea just how far your government has gone in the name of expediency and convenience? Apparently, the only toys that are dangerous is the law, which is being treated like a toy by our government.

I saw someone post about an Eagle Scout and it just brought back my curiosity...

I went through the whole thing, and loved it.  When I turned 8, I started Cub Scouts, when I turned 11, I did "Webelos" and when I turned 12, I entered Boy Scouts.  I went up to the "Life" rank, right before Eagle in the minimum time possible, but (as so many do) right about that time I started high school and got into sports, etc and BSA was no longer a priority (nor was it "cool").  I eventually got it finished at the age of 17, at my parents prodding (sat out one season of sports - baseball - to do it as well).  At the time, I was upset, and the only thing that held me back from the Eagle award was the project.  I had enough merit badges to get a silver and bronze palm afterwards thanks to going to Camp Geronimo every year (is that still open?  It was the coolest place up north near the Mogollon Rim).  

Anyway, today, about 10 years afterwards, I am not active in scouting - though I did the Order of the Arrow for a time afterwards - but I can say that I am thankful that my parents did "force" me to get the Eagle Scout award.  I am always remembering things I learned in Scouts (the memories are cool, too).  However, I can honestly say that it has been the difference between me getting hired for a position - in at least two occasions.  You'd really be surprised how much interviewers think of it, and it has always been on my resume.

I just want to remind everyone to <u><b>add your events to the calendar</b></u><img src="http://www.airsoftarizona.com/firearms/forum/images/speech/icon_speech_yeah.gif" border="0">.  I receive an obscene amount of email regarding when games are, and details.  If you guys put your games in the calendar along with details about them (who, what, when, where, rules, ages, etc), I'm sure you will get a lot better attendance at the games<img src="http://www.airsoftarizona.com/firearms/forum/images/speech/icon_speech_duh.gif" border="0">. [:D]

My wife and I went. We had planned on seeing it when it came out next weekend, but had the opportunity to see it this weekend at a pre-screening. It was just over 2 hours long.

All-in-all, I give it an "A-". In a nutshell, if you liked "The Goonies" as a kid, you will like this. It's just one of those "fun" movies.

He was posthumously given the rank of Corporal (from Specialist) and a Silver Star:

Tillman left behind his NFL career as a safety with the Arizona Cardinals to join the Army after the attacks of September 11, 2001.

He served as an Army Ranger in Afghanistan.

He was shot and killed April 22 during a ground convoy assault not far from Khowst, Afghanistan, near the eastern border with Pakistan.

Al Qaeda remnants are thought to be holed up along the border region.

The Army gave the following account of Tillman's actions:

"Tillman's platoon was split into two sections. Tillman was the team leader of the lead section when the trail section began receiving suppressive mortar and small-arms fire. ... [The] cavernous terrain made it extremely difficult to target enemy positions, and there was no room for the trail element to maneuver out of the kill zone.

Even though his element was out of the area that had come under fire, Tillman "ordered his team to dismount and maneuvered his team up a hill toward the enemy's location," the Army said.

During the battle, he issued "fire commands to take the fight to the enemy on the dominating high ground," the statement continued.

"Only after his team engaged the well-armed enemy did it appear their fires diminished."

Because of Tillman's leadership and his team's efforts, the trail section under fire "was able to maneuver through the ambush to positions of safety without a single casualty," the Army said.

Tillman was a member of A Company, 2nd Battalion, 75th Ranger Regiment based at Fort Lewis, Washington.

He was promoted posthumously from specialist to corporal, an Army spokeswoman told The Associated Press on Thursday.

"The Army always notes that rank and promotion are not a reward of what was done well, but a recognition that you have the potential to do more," Army spokeswoman Martha Rudd told the AP. "This promotion is essentially saying he would have been a fine leader."

For those of you who have been around for over a year at AA, you'll remember one of our former members, Christian Allen aka "The Rooster" who left us to take his dream job with Red Storm Entertainment (makers of Rainbow Six/Ghost Recon series).  I got my CGW new issue today and there's an article with him in it (page 27, June 2004 issue).  Apparently he is the head designer of Ghost Recon 2!  Way to go Christian!
