Heller denied

Hum, no surprise here, but still very dissapointing.

"WASHINGTON (WUSA) -- District residents can start registering their guns today. But at least one very high profile application was already rejected.

Dick Heller is the man who brought the lawsuit against the District's 32-year-old ban on handguns. He was among the first in line Thursday morning to apply for a handgun permit.

But when he tried to register his semi-automatic weapon, he says he was rejected. He says his gun has seven bullet clip. Heller says the City Council legislation allows weapons with fewer than eleven bullets in the clip. A spokesman for the DC Police says the gun was a bottom-loading weapon, and according to their interpretation, all bottom-loading guns are outlawed because they are grouped with machine guns.

Besides obtaining paperwork to buy new handguns, residents also can register firearms they've had illegally under a 180-day amnesty period.

Though residents will be allowed to begin applying for handgun permits, city officials have said the entire process could take weeks or months. "

Thoughts?

They have not rewritten any of the law that the court ruled as unconstitutional yet so a lot of the crap they were using has not been fixed.

you mean WON'T be fixed.  They're not going to change anything until they get sued.  again.  they put up their idea of "reasonable" restrictions, said come on in and try to register, then called it good, problem solved.

One solution that may come down is Congress has the absolute authority to exercise supremecy within the District and can dictate policy.   Congress could simply pass legislation creating the handgun laws for the District, even though they cannot do so for the states.

The po po is going to resist this change for sure and if you are in DC its still going to be a long uphill battle.  There will be more legal challenges and in time things will gel there in DC.

The problem with the news reports on this issue is its all political and sensational so no real news is being provided - that and most journalists don't know a damn thing about the law and how separation of powers works to balance things...

Once of the reasons I chose to live in Arizona was because its easy for law abiding members of society to be armed without making it any easier for the bad guys to be armed.

I read somewhere about a group that is trying to get everyone in "open carry states" to carry their weapons opensly all at the same time on some kind of symbolic basis - theory being use it or loose it and if people get used to seeing it they will accept it.  I don't know about all that but its nice to know that if I want to open carry I can.... and if I want to cover it up I can....

absopositutely!  I love having the option.  When I'm home in Texas, it gets to be kind of annoying to ALWAYS cover up my gun.

Oh, and I don't think it's a matter of if Congress COULD, but if Congress WOULD pass legislation to that effect

Lou Dobbs has covered this story, Glenn Beck was talking about how ridiculous it was that you need to put a trigger lock or keep the gun dissembled. Those two support the right to carry.
